TERMS
1 . All invoices are due on receipt.
2. Invoices are forwarded to the address designated by customer upon completion of the services requested. Invoices remaining unpaid more than ten (10) days after the date of invoice shall accrue interest at the rate of one and one half percent (1 1 / 2%) per month from the due date until paid, and NT B, Inc. shall be entitled to recover in addition thereto all costs of collection, including NT B, Inc. reasonable Attorney fees and court costs.
3. N TB Incorporated & Subsidiaries shall not be liable for special, incidental or consequential damages, nor shall NTB Incorporated & Subsidiaries be responsible for damage caused by others.
4. The goods and services we provide in connection with our professional pool opening/winterization comply with industry standards for this geographical region and your particular installation. We represent to you that upon completion of your pool opening/winterization, each item of the “check off list” attached to our agreement, and applicable to your particular pool and equipment, will have been properly performed. Although the use of reasonable care both in the design and execution of your pool’s opening/winterization program should maximize your pool’s life and minimize corrective maintenance, factors of nature, weather and environment beyond anyone’s control can adversely affect the condition of your pool and equipment as well as the quality of the residual pool water. For that reason NTB, Inc. cannot act as an insurer with respect to your pool, water or equipment and disclaims any and all warranties, express or implied, including warranties of merchantability and fitness for particular purpose in connection with the goods and services provided in opening/winterization your pool for the season, other than any applicable manufacturer’s warranties.
